In two recent CAT judgments, Google and Apple failed in having their opponent’s ATE insurance terms disclosed on the basis of gaining an ‘unfair tactical advantage’. The bigger question is if defendants expect greater disclosure on insurance and funding arrangements, shouldn’t defendants equally be willing to give greater disclosure and transparency about their position too?
